Highway Flooring NJ LLC - Terms & Conditions (Revised 02-28-2016)
Please ensure that all the following conditions are met to prepare your floor for purchase, sanding/refinishing and installation whichever may apply. Your cooperation is greatly appreciated. Failure to comply with this checklist constitutes a waiver on your part and releases Highway Flooring NJ LLC from any responsibility. If you have questions or need clarification, please contact us. All contracts/proposals must be paid in full before any claims or services are performed. By signing the contract, you agree to the following terms:
1. Pricing & Returns
1.1 The prices on this contract are subject to change under uncontrolled situations.
1.2 Some in-stock flooring materials may be returned within 21 days of order placement, provided they are in their original packaging and condition. A 30-40% restocking fee applies, and the customer is responsible for transportation costs. Accessories are non-returnable. Most floors are non-refundable. Floors sold at a discount are sold "as is" with no warranty or return option.
2. Product Characteristics & Installation Standards
2.1 Natural imperfections and slight milling defects (e.g., height differences and gaps) are expected. A 5% industry tolerance applies, including transit damages. Floor length variations and molding color mismatches are standard.
2.2 A 5% to 15% overage is common. Excess material is non-returnable unless notified by Highway Flooring NJ LLC. Customers should retain extra materials for future repairs. If additional materials are required, the customer agrees to cover the costs.
2.3 Discounted, clearance, sale-priced, or promotional products purchased via credit card or financing are sold "as is" with no warranty.
2.4 Contract fulfillment is subject to material availability and unforeseen circumstances.
3. Delivery & Responsibility
3.1 All deliveries are curbside. Customers are responsible for unloading materials and moving them inside. Packing materials are part of the order.
3.2 Customers agree to the terms of all manufacturers and brands. For quality issues, customers must contact the manufacturer, distributor, or importer. Highway Flooring NJ LLC is not responsible for product defects, even if the supplier is out of business.
3.3 Material measurements are estimates. Customers agree to accept overages or pay for underestimated portions if necessary.
3.4 Curbside delivery requires a truck-accessible street address. The driver is not responsible for moving materials inside or unloading to the ground. Customers or their representatives must be present to remove materials from the truck.
4. Liabilities & Limitations
4.1 Highway Flooring NJ LLC cannot guarantee a floor without cracks or separations between boards due to natural seasonal moisture changes, including filler cracks from sanding and refinishing jobs.
4.2 We are not responsible for collateral damage or dust-related issues from activities such as tile removal, carpet removal, sanding, or sawing. Customers should take precautions to protect belongings.
4.3 The job will be completed in a continuous manner unless otherwise agreed in writing. Work may pause for weekends and holidays.
4.4 Highway Flooring NJ LLC reserves the right to stop work if a customer fails to meet their obligations. Restarting the project incurs a $1,000 fee for every $5,000 of work.
4.5 Customers must maintain proper temperature and humidity for flooring as recommended by the NWFA (Temperature: 65°F to 75°F, Humidity: 30% to 50%). Highway Flooring NJ LLC is not liable for issues like checking, cracking, or cupping due to improper climate control.
4.6 110V power and a fuse box must be available within 30 feet of the installation area. Work hours typically range from 8 AM to 5 PM.
5. Customer Responsibilities
5.1 Customers must protect materials left on-site and address any damages caused by other trades during installation. Any concerns must be reported via email (njfloor@gmail.com) within 3 days.
5.2 Rooms must be cleared of furniture, doors, and debris before work begins. We are not responsible for re-installing doors or moving furniture.
5.3 For safety reasons, customers should maintain a 15-foot distance from the work area, wear shoes, and use protective gear.
5.4 Highway Flooring NJ LLC has discretion over emergency situations. Customers should have insurance to cover accidents or damages.
5.5 If we move furniture at the customer's request, we are not responsible for damages and will not return items to their original locations.
5.6 Appliances and fixtures (e.g., toilets, vanities, stoves, refrigerators) must be removed before installation. If Highway Flooring NJ LLC assists, we are not responsible for any issues that arise.
5.7 Sanding, staining, and refinishing are a blend of art and science. Customers should inspect floors under normal lighting from a standing position and not expect a tabletop finish.
5.8 Sub-floor issues (e.g., leveling, squeaks) are not corrected by installation. Customers accept responsibility for pre-existing conditions unless addressed in writing.
5.9 Glue-down floors require 48 hours to cure. Sanded and refinished floors need at least 48 hours before light foot traffic.
5.10 Waste disposal (e.g., old carpet, boxes, debris) is the customer’s responsibility.
6. Project Completion & Payments
6.1 Customers must provide a final punch list of concerns upon project completion. If absent at completion, the job is considered finished.
6.2 Final payment is required after a walkthrough. Service calls after job completion may incur additional charges.
6.3 Sanding, refinishing, and repair work do not guarantee color/sheen matching or stain removal. Customer-supplied materials void warranties.
6.4 Unless specified, flooring direction is at our discretion. Custom installations (e.g., 45-degree angles, borders, medallions) incur additional costs.
6.5 Variations in wood grain, texture, and color are natural and acceptable.
6.6 Minor scratches, scuffs, wood filler separations, glue marks, and nail holes are normal in wood flooring.
7. Pets & Property
7.1 Customers must secure pets during the project. Highway Flooring NJ LLC is not responsible for pets escaping due to open doors or windows.
7.2 Once the project is suitable for its intended use, it is considered substantially complete and final payment is required.
7.3 Highway Flooring NJ LLC retains copyrights to all job site photos for documentation and marketing.
8. Legal & Collection Policies
8.1 This contract is governed by the laws of New Jersey, with disputes resolved in New Jersey courts.
8.2 All communications between customers and Highway Flooring NJ LLC are documented for quality control.
8.3 Customers must pay any collection costs, including attorney fees and lien preparation. Highway Flooring NJ LLC may halt work for late payments. By signing the contract, you acknowledge and agree to these terms. For any questions, please contact us before proceeding.
